Agreement 1.1 The terms and conditions of this document together with your booking form comprise the agreement between Chalet Slovakia and all those listed on the booking form, on whose behalf the group leader has signed. The contract is deemed to have been made as soon as the signed booking confirmation form is received by Chalet Slovakia. 1.2 The group leader is responsible, on behalf of all other members of the group, for all matters relating to the booking, thus he/she will be personally liable for all monies outstanding from the remainder of the guests. 1.3 “The group” refers to all persons booked to stay in the accommodation listed on the booking form and also includes any subsequent changes of names to the original booking. 1.4 If at any time, prior to the start of the holiday, there is a change of group leader Chalet Slovakia must be notified, either by email or telephone, by the original group leader and a new booking confirmation and terms and conditions form must be signed by the new group leader and returned to Chalet Slovakia before embarking on the holiday. Bookings 2.1 Once availability has been confirmed, by Chalet Slovakia a booking enquiry will be held for 7 working days, pending receipt of the appropriate deposit (£50 per guest) and the completed booking form. 2.2 Thereafter the booking will be deemed cancelled and Chalet Slovakia reserves the right to re-book the week without notification. 2.3 The total amount outstanding on your holiday must be paid within 8 weeks of arrival. For bookings made within this period the full cost of the holiday will be payable at the time of booking. 2.4 If the final balance is not received 8 weeks prior to the day the holiday commences Chalet Slovakia reserve the right to cancel the booking and any deposits paid will be forfeited (every effort will be made to contact the client to remind them of payment dates). Chalet Slovakia then reserves the right to re-book the chalet without further notice. Alterations to the booking 3.1 If you wish to alter the booking after the contract is formed, we will do our best to arrange this.  Cancellation by you 4.1 All changes and cancellations must be made in writing and received by email before the departure date. 4.2 From 12 - 1 week a refund of any total payment already paid minus your deposit will be given. Price variations by Chalet Slovakia 5.1 Whilst we reserve the right to change our prices from time to time, your confirmation invoice price will not change. Holiday Insurance 6.1 Skiing, snowboarding and other outdoor pursuits can be dangerous both on and off piste/designated areas. Chalet Slovakia will endeavor to make your trip as safe as possible, but not all risks, dangers and hazards can be anticipated or avoided. Therefore you MUST be insured for the entire duration of your stay which covers you for cancellation, curtailment, winter sports/outdoor activities including mountain rescue and repatriation. Alterations to your holiday by Chalet Slovakia 7.1 Arrangements to your holiday as described in these Booking Conditions are made many months in advance. We reserve the right to make any such necessary changes. Most will be very minor and we will notify you of any major changes. In the event of a major change you have a choice: A) accept the change B) purchase another holiday from us C) cancel your holiday. Cancellation by Chalet Slovakia 8.1 We reserve the right in any circumstances to cancel your holiday, and to return all money you have paid to us, or offer you an alternative holiday to purchase. However, in no case will we cancel your holiday less than 8 weeks before departure, except for reasons outside our control including, but not limited to reasons of Force Majeure. Chalet Slovakia liability 9.1 Chalet Slovakia does not accept any liability wheresoever or howsoever arising, or pay compensation for: Any event which Chalet Slovakia could not foresee or avoid, amounting to Force Majeure (Force Majeure meaning war, political unrest, weather, strikes, acts of God, epidemics, riots, civil strife, industrial disputes, terrorist activity, natural or technical disasters, nuclear war) Any cancellation, loss, delay or costs wheresoever or howsoever arising or connected with adverse weather or traffic conditions, avalanche, mud slips, slides and snow conditions and the effect any of these may have on travel arrangements, accommodation and activities. Limitations imposed by resort authorities, ski-lifts, ski school, ski hire operators or by any external companies we utilise such as rafting companies and aqua parks. Travel arrangements made by the group or on behalf of the group. Any personal injury, illness or death wheresoever or howsoever arising caused to any visitor and/or any member of the group for their duration of stay. This is not intended to exclude any statutory rights the group and/or visitor may have. This agreement and any proceedings there under are to be governed by English Jurisdiction. 9.2 A person who is not a party to this Contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Contract provided always this does not affect any right or remedy of a third party which exists or is available apart from this Act. Third Party Activities 10.1 Chalet Slovakia source and book many third party services you use when on holiday, these services are subject to the terms and conditions of the individual companies. 10.2 Chalet Slovakia takes no responsibility or liability for his or her service. Any grievance with a third party service should be taken up with the provider directly. The responsibility of Chalet Slovakia 11.1 Chalet Slovakia organises its ski/ snowboard/outdoor pursuit programme with your safety in mind. Chalet Slovakia has its complete discretion to vary or cancel its sports programmes such as mountain guiding/escorting or lessons according to weather conditions and the experience of the group members. If you have a complaint 12.1 We do try to ensure your holiday with us is as enjoyable as possible. If you have a complaint please: a) whilst on holiday. Immediately inform the manager, who will try to put things right quickly. B) on your return home. Within 28 days follow up your complaint by writing to our UK office. Internet Information accuracy 13.1 The Booking Conditions have been prepared from advance information. Whilst every care is taken that this information is correct at time of your booking it has to be remembered that holiday particulars may change. Whilst every effort is made to ensure that all information is correct, Chalet Slovakia cannot be held responsible if this should prove inaccurate. Special requests 14.1 If you have any special requests that are not covered by the holidays described in our website or these Booking Conditions please let us know. We will try to meet such requests but cannot guarantee to do so. Valid passports are required for visitors to Slovakia 15.1 Visas are NOT required for EU citizens. Other nationals may require a visa and should enquire at the Slovakian Embassy. Flights 16.1 You are responsible for booking your own flights. Chalet will assist you in finding suitable flights if you so desire. Chalet Slovakia accepts no responsibility for problems with your flights. All problems or complaints about flights should be dealt with directly with your chosen carrier. Safety standards 17.1 Please note, it is the requirements and standards of the country in which any services which make up your holiday are provided which apply to those services and not those of the UK. As a general rule, these requirements and standards will not be the same as the UK and may sometimes be lower. Ski/Snowboard/Mountain Bike hire 18.1 Damage or loss to hired ski/snowboard/bike equipment is entirely your own responsibility. All payments for damage, loss or renewal must be paid to Chalet Slovakia by you before departure. This inculdes equipment hired from Chalet Slovakia and external companies. Responsibilities, behavior and property damage 19.1 If a guests behavior is adjudged by the manager and the staff of Chalet Slovakia as antisocial and also detrimental to other guests staying at the chalet or have a negative effect on the reputation of Chalet Slovakia, the manager reserves the right to terminate their holiday on grounds of antisocial behavior with no refund to their loss of holiday. 19.2 If a guest damages any property of Chalet Slovakia. The person/s involved will have to pay the full recommended retail price for the damaged goods and items. Failure to pay will result in appropriate legal action and the cancellation of your groups holiday. 19.3 Any persons not with Chalet Slovakia can only visit guests with prior notification and permission of chalet staff, with chalet staff being present at all times. If a client is in breach of the terms and conditions Chalet Slovakia reserve the right to refuse to further accommodate them and contractual obligations will be terminated immediately. Transport and Airport Transfers 20.1 Chalet Slovakia provide a free transportation service to and from Poprad airport and around the local area for your convenience, the use of this vehicle is taken entirely at your own risk and Chalet Slovakia take no responsibility for death or personal injury caused through the use of this service. Please note that the use of the vehicle is provided free of charge and does not form part of the holiday cost. 20.2 Chalet Slovakia do not provide child booster seats. It is the Childs parents or guardians responsibility to provide the necessary child booster seat before traveling in any Chalet Slovakia vehicle. If the parent or guardian does not provide a child booster seat for their child, transportation in any Chalet Slovakia will be refused. Smoking 21.1 For health and safety reasons smoking is strictly prohibited within the chalet and their company vehicles. If people wish to smoke they must do so outside of these areas. Children 22.1 No matter how much care is taken, our chalet is not childproof. Chalet Slovakia will not be held responsible for any accidents occurring within the chalet, it is the parent’s responsibility to ensure their children are supervised at all times. All guests under the age of 18 must be accompanied by adults. The minimum age of independent travel and booking with Chalet Slovakia is 18 years of age. Ski/Snowboard/ Walking/Mountain Biking companion service 23.1 If Chalet Slovakia offer a ski/snowboard/walking/mountain biking/any other sport companion service, please note this is NOT ski/bike guiding - our staff are not professional guides in that they do not hold a guide qualifications or have the necessary insurance. If you choose to venture off piste skiing/ snowboarding whilst in the company of a staff member you will be strongly advised against any such action unless you employ a professional mountain guide and the appropriate equipment. Should you choose to ignore our advice, you assume all responsibility for your actions and the inherent dangers such as of off piste skiing/snowboarding.
